These Terms of Service ("Terms") govern use of PitStorm, operated by Neuroptune LLC ("we," "us," or "our"). By creating an account or using PitStorm, you agree to these Terms.
1. Description of Service
PitStorm is a software platform that allows auto repair shops to check in vehicles, track repair status, and notify vehicle owners via text message and a status-tracking web page.
2. Accounts
Shops are responsible for maintaining the confidentiality of their account credentials and for all activity under their account. Shop staff must have authority to act on behalf of the Shop.
3. Acceptable Use
Shops agree to:
- Only enter accurate vehicle and customer information
- Only send status update texts to Vehicle Owners who have explicitly consented via PitStorm's check-in flow
- Not use PitStorm to send content unrelated to vehicle service status
- Not attempt to customize, alter, or repurpose PitStorm's messaging content or opt-in language
PitStorm reserves the right to suspend accounts that misuse the messaging system or violate applicable law, including TCPA and carrier messaging policies.
4. Subscription & Payment
Shop subscriptions are billed via Stripe on a recurring basis as described at signup. Fees are non-refundable except as required by law. Failure to pay may result in suspension or termination of access.
5. Text Messaging
PitStorm sends automated texts on behalf of Shops to Vehicle Owners who opt in through our check-in flow. Message content is fixed and controlled solely by PitStorm; Shops may not customize or send their own messages through the platform. See our Privacy Policy for full SMS terms.
6. Intellectual Property
PitStorm and all associated software, design, and content are owned by Neuroptune LLC. Shops are granted a limited, non-exclusive, non-transferable license to use the platform for its intended purpose.
7. Disclaimers
PitStorm is provided "as is" without warranties of any kind, express or implied. We do not guarantee uninterrupted or error-free service.
8. Limitation of Liability
To the maximum extent permitted by law, Neuroptune LLC's total liability for any claim arising from use of PitStorm is limited to the fees paid by the Shop in the 3 -month period preceding the claim. We are not liable for indirect, incidental, or consequential damages.
9. Indemnification
Shops agree to indemnify Neuroptune LLC against claims arising from their misuse of the platform, including sending unauthorized messages or entering inaccurate customer data.
10. Termination
Either party may terminate an account at any time. We may suspend or terminate accounts that violate these Terms, including improper use of SMS messaging.
11. Governing Law
These Terms are governed by the laws of the State of Kansas, without regard to conflict of law principles.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of PitStorm after changes constitutes acceptance.
